01Acceptance of terms

This Terms of Use and End User License Agreement (this "Agreement") is a binding legal contract between you, either an individual or an entity ("you," "User"), and yforest LLC, a Texas limited liability company with its principal place of business at 2450 Lakeside Pkwy, Suite 150 PMB 1195, Flower Mound, TX 75022 ("yforest," "Licensor," "we," "us"). This Agreement governs your access to and use of the Aura Radar desktop software application for Windows and macOS, together with all related documentation, updates, and license validation services (collectively, the "Software").

By purchasing, downloading, installing, activating, or using the Software in any way, you accept and agree to be bound by this Agreement. On first launch, the Software presents a clickwrap acceptance screen requiring an affirmative click-through before any feature becomes usable; that click constitutes your electronic signature to this Agreement. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

If you do not agree to every term of this Agreement, do not download, install, activate, or use the Software. If you have already purchased a license and do not agree, uninstall the Software immediately and request a refund in accordance with Section 10 within the applicable refund window. Continued use of the Software after any update to this Agreement constitutes acceptance of the updated terms as described in Section 20.

02Definitions

The following defined terms apply throughout this Agreement:

"Creator Use" means use of the Software by an individual, a sole proprietor, or a small independent channel or brand to produce a live or recorded video stream published to consumer social or streaming platforms such as YouTube, Twitch, Kick, Facebook, TikTok, X, or similar services, or displayed privately (for example, on a personal or in-home display). Creator Use does not include Broadcast Use.

"Media Organization" means any of the following, and any affiliate of, or contractor producing content for, any of the following: (a) a broadcast television or radio station or network; (b) a cable or satellite television or radio channel; (c) a FAST channel, OTT service, or streaming network organized around distributing programming to the public; (d) a newspaper, magazine, or other news publisher, or a wire service; (e) a government agency; (f) a university or college media or broadcasting department; or (g) any entity that has more than twenty-five (25) employees or more than five million U.S. dollars (US$5,000,000) in annual gross revenue, regardless of industry.

"Broadcast Use" means any display, transmission, retransmission, or incorporation of output generated by the Software — including screenshots, video clips, still frames, or derivative graphics produced from that output — in, on, or for the programming, digital properties (including websites and apps), or social media accounts of a Media Organization, whether the use is live, recorded, delayed, embedded, syndicated, or otherwise distributed.

"Output" means the visual and audio presentation rendered by the Software, including its radar imagery, map, HUD graphics, storm cards, ticker text, and soundscape, as displayed on a User's screen or captured by streaming software.

"License Key" means the unique alphanumeric credential issued to you upon purchase, which the Software validates against a specific machine.

"Order" means the checkout transaction through which you purchased a license, processed by LemonSqueezy as described in Section 10.

03Creator license grant

Subject to your continued compliance with this Agreement and payment of all applicable fees, yforest grants you a personal, non-exclusive, non-transferable, revocable, limited license to install and run the Software solely for Creator Use.

This license permits you to:

Each License Key is licensed for use on one machine at a time. On first activation, the Software pairs the License Key to that machine's hardware identifier ("machine-GUID"). The Software performs online license validation each time it launches; if the machine cannot reach the validation service, the Software will continue to operate under a 24-hour offline grace period before validation is required again. Moving a License Key to a different machine requires deactivating it on the original machine or contacting support@yforest.ai for a manual transfer; we may limit the number of transfers permitted per License Key to prevent abuse.

One-time (Creator Perpetual) license. A one-time purchase grants a perpetual license to the version of the Software current at the time of purchase and all subsequent v1.x updates and patches released at no additional charge. A future major version (v2) is offered as a separate, optional paid upgrade at a price set by yforest (currently anticipated at US$99); you are never required to purchase an upgrade to continue using the version you already licensed.

Subscription (Creator Subscription) license. A monthly subscription grants a license to use the then-current version of the Software, including all major and minor versions released, for as long as your subscription remains active and paid. You may cancel at any time as described in Section 10; your license terminates at the end of the then-current billing period.

04Restrictions

Except as expressly permitted in Section 3 or a separate written Broadcast License under Section 5, you shall not, and shall not permit any third party to:

Any use outside the scope of the license granted to you is unauthorized and constitutes a material breach of this Agreement.

05Broadcast & Media Organization license

The Creator licenses described in Section 3, priced at US$199 one-time or US$29 per month, are licensed solely for Creator Use and are not available to, and may not be used by, any Media Organization for Broadcast Use under any circumstance.

A Media Organization that wishes to engage in Broadcast Use of the Software or its Output must first obtain a separate written Broadcast & Media Organization License ("Broadcast License") from yforest. A Broadcast License is granted only by a signed written agreement, obtained by contacting support@yforest.ai, and is not available through the standard LemonSqueezy checkout.

A Broadcast License is granted per legal entity. Affiliates, subsidiaries, and separately organized business units of a Media Organization each require their own Broadcast License unless the written agreement expressly extends coverage to them.

Broadcast Use by a Media Organization without a written Broadcast License is unauthorized. It constitutes both copyright infringement and a material breach of this Agreement. By engaging in Broadcast Use without a written Broadcast License, a Media Organization agrees that the Broadcast License fee of US$100,000 is immediately due and owing to yforest as the agreed license fee for such use, in addition to, and not in lieu of, all other remedies available to yforest at law or in equity, including injunctive relief, statutory damages under applicable copyright law, and recovery of yforest's reasonable attorneys' fees and costs.

Safe harbor. This Section is not intended to reach incidental, non-commercial appearances of the Output — for example, a news story that discusses a creator and briefly shows a clip of that creator's stream, where the Output appears only because it happens to be visible in the underlying footage and where such use qualifies as fair use. This Section is directed at deliberate, commercial, or programmatic Broadcast Use of the Software or its Output as part of a Media Organization's own weather coverage, branding, or programming.

06Ownership & intellectual property

The Software, including its source code, object code, visual and audio design, heads-up display ("HUD") layout, storm-card design, cinematic map rendering style, the AudioDirector soundscape and all associated audio assets (ambient pads, motifs, rain beds, and thunder cracks), and the general look, feel, and rendering style of the Output, are and remain the exclusive intellectual property of yforest LLC, protected by U.S. and international copyright, trade secret, and other intellectual property laws. No rights are granted to you other than the limited license expressly set out in this Agreement.

You retain all rights in your own logo, watermark, station branding, spoken or written commentary, and any other original content you add to or overlay on the Output. yforest claims no ownership over such User-supplied branding or commentary.

If you submit feedback, suggestions, or ideas about the Software to yforest, you grant yforest a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that feedback into the Software or any other yforest product without obligation or compensation to you.

07Third-party & public data

The Output is derived in part from publicly available meteorological data sources, including but not limited to the National Weather Service (NWS), the National Oceanic and Atmospheric Administration (NOAA), the Multi-Radar Multi-Sensor system (MRMS), NEXRAD radar sites, GOES satellite imagery, the Geostationary Lightning Mapper (GLM), aviationweather.gov, the Iowa Environmental Mesonet (IEM) operated by Iowa State University, and Natural Earth basemap data (collectively, "Public Data Sources").

These Public Data Sources are provided by their respective government agencies and institutions and are used under their applicable public-data terms. None of the Public Data Sources, and none of the agencies or institutions that publish them, endorse, sponsor, or are affiliated with yforest or the Software. yforest does not control the availability, timeliness, completeness, or accuracy of any Public Data Source, and outages, delays, or errors originating from a Public Data Source are outside yforest's control. Where required by a Public Data Source's terms, yforest provides attribution within the Software or its documentation.

08Not a safety or warning service

AURA RADAR IS AN ENTERTAINMENT AND INFORMATIONAL PRODUCT. IT IS NOT A LIFE-SAFETY SYSTEM, EMERGENCY ALERTING SYSTEM, OR OFFICIAL WEATHER WARNING SERVICE.

THE OUTPUT MAY BE DELAYED, INCOMPLETE, OUT OF DATE, OR SIMPLY WRONG. NEVER RELY ON AURA RADAR, IN WHOLE OR IN PART, FOR ANY DECISION AFFECTING LIFE SAFETY, INCLUDING DECISIONS ABOUT SEEKING SHELTER, EVACUATING, OR OTHERWISE RESPONDING TO SEVERE WEATHER.

THE NATIONAL WEATHER SERVICE, NOAA WEATHER RADIO, AND YOUR LOCAL EMERGENCY MANAGEMENT AGENCY ARE THE AUTHORITATIVE SOURCES FOR WEATHER WATCHES, WARNINGS, AND EMERGENCY INSTRUCTIONS. ALWAYS CONSULT THOSE SOURCES DIRECTLY.

If you broadcast or publicly display the Output to any audience, you are responsible for including a comparable disclaimer, visible or stated to your audience, making clear that your channel is not an official source of weather warnings and that viewers should consult the National Weather Service or local emergency management for life-safety decisions.

09Platform compliance

If you stream or publish the Output to YouTube, Twitch, or any other third-party platform, you are solely responsible for complying with that platform's terms of service, community guidelines, content policies, and any applicable music or audio-licensing policies. The AudioDirector soundscape included in the Software can be disabled entirely from the settings panel if your platform's audio policies require it, or if you prefer to stream without it. yforest is not responsible for any platform enforcement action, strike, demonetization, or account suspension arising from your use of the Software on a third-party platform.

10Payments, taxes, refunds & subscriptions

All purchases are processed by LemonSqueezy.com Inc., which acts as the merchant of record for all Orders. Your payment information is collected and processed by LemonSqueezy, not yforest, and your relationship with LemonSqueezy as a payment processor is governed by LemonSqueezy's own terms. LemonSqueezy is responsible for calculating, collecting, and remitting applicable sales tax, VAT, or similar transaction taxes as merchant of record.

One-time license refunds. If you purchased the one-time Creator Perpetual License, you may request a full refund within fourteen (14) days of purchase, provided that (a) the License Key has been activated on no more than one (1) machine, and (b) you report a genuine defect or malfunction of the Software that yforest is unable to resolve. Refund requests are made by emailing support@yforest.ai with your Order number. Approved refunds result in immediate deactivation of the associated License Key.

Subscriptions. Monthly subscription charges are non-refundable for the current billing period once charged. You may cancel your subscription at any time through your LemonSqueezy customer portal or by emailing support; cancellation takes effect at the end of the then-current paid period, and you retain access to the Software until that period ends, after which the license terminates.

Price changes. yforest may change the price of the one-time license or the subscription for future purchasers or future billing periods at any time, with reasonable advance notice to existing subscribers before a price change takes effect on their subscription. Price changes do not affect licenses already purchased.

Chargebacks. Initiating a chargeback or payment dispute instead of first contacting yforest for a refund is treated as a material breach of this Agreement and will result in immediate termination of your license and deactivation of your License Key.

11Updates, support & availability

yforest provides best-effort customer support by email at support@yforest.ai. We do not guarantee any specific response time or resolution.

yforest may, at its discretion, add, modify, deprecate, or discontinue features of the Software, including data layers, HUD elements, or soundscape assets, at any time. We may also discontinue the Software entirely upon reasonable notice. A future major version (v2) will be offered as described in Section 3; owners of a one-time Creator Perpetual License are never required to purchase v2 to keep using their licensed v1.x version, subject to continued availability of supporting infrastructure such as Public Data Sources and license validation services.

12Privacy

To perform license validation, the Software transmits to yforest's validation service your License Key, a machine identifier (machine-GUID), the installed application version, and your IP address at the time of validation. This information is used solely to enforce the one-machine-per-key limitation described in Section 3, to provide support, and to maintain the security of the licensing system.

The Software does not collect, transmit, or record the content of your stream, your radar view, your microphone, or any audience data. yforest does not monitor what you broadcast.

13Termination

This Agreement and the license granted under it terminate automatically, without notice, if you breach any term of this Agreement, including engaging in unauthorized Broadcast Use, sharing or reselling a License Key, or circumventing license validation. yforest may also terminate a license following a chargeback as described in Section 10, or terminate a subscription license at the end of a billing period upon your cancellation.

Upon termination, your right to use the Software ends immediately, your License Key will be deactivated, and you must uninstall the Software and destroy any copies in your possession. Sections of this Agreement that by their nature should survive termination — including Ownership, Not a Safety Service, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law & Disputes — survive termination of this Agreement.

14Disclaimer of warranties

THE SOFTWARE AND ITS OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YFOREST DISCLAIMS ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

YFOREST DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE OUTPUT WILL BE ACCURATE, COMPLETE, OR TIMELY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

15Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL YFOREST BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF THE SOFTWARE, EVEN IF YFOREST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YFOREST'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT WILL NOT EXCEED THE TOTAL AMOUNTS YOU ACTUALLY PAID TO YFOREST FOR THE SOFTWARE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. NOTHING IN THIS AGREEMENT LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

16Indemnification

You agree to defend, indemnify, and hold harmless yforest LLC, its officers, members, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Software in violation of this Agreement; (b) any content you broadcast, stream, or publish using the Software, including any claims of defamation, invasion of privacy, or intellectual property infringement relating to that content; (c) unauthorized Broadcast Use as described in Section 5; or (d) your violation of any third-party platform's terms of service or policies.

17Export, government users & age

The Software may be subject to U.S. export control laws and regulations. You represent that you are not located in, and will not use the Software in, any country subject to a U.S. government embargo, and that you are not listed on any U.S. government list of prohibited or restricted parties.

If you are a U.S. government end user, the Software is a "commercial item" as defined under applicable federal acquisition regulations, and is licensed to government end users only with the rights and restrictions described in this Agreement.

You must be at least eighteen (18) years old, or the age of majority in your jurisdiction if higher, to purchase or accept this Agreement. The Software is not directed to, and may not be used by, individuals under eighteen (18).

18Governing law & disputes

This Agreement is governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Subject to the arbitration provision below, the state and federal courts located in Denton County, Texas, will have exclusive jurisdiction and venue over any dispute not subject to arbitration, and you consent to personal jurisdiction in those courts.

Informal resolution first. Before filing any arbitration or lawsuit, you agree to first contact yforest at support@yforest.ai and attempt in good faith to resolve the dispute informally for at least thirty (30) days.

Binding arbitration. If a dispute is not resolved informally, you and yforest agree that it will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court, except that either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive or other equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or unauthorized Broadcast Use.

Class action waiver. You and yforest agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, collective, or representative action, and the arbitrator may not consolidate more than one person's claims.

Opt-out. You may opt out of this arbitration provision by sending written notice to support@yforest.ai within thirty (30) days of the date you first accept this Agreement. Your notice must include your name and a clear statement that you wish to opt out of arbitration.

19DMCA & copyright complaints

If you believe content associated with the Software or a user of the Software infringes your copyright, send a notice that satisfies the requirements of the Digital Millennium Copyright Act to support@yforest.ai, including: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and its location; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; (e) a statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature.

20General provisions

Changes to this Agreement

yforest may update this Agreement from time to time. Material changes will be reflected by an updated "Effective date" at the top of this page, and where practical we will provide notice by email or in-app notice. Your continued use of the Software after an updated Agreement takes effect constitutes acceptance of the changes.

Entire agreement

This Agreement, together with any written Broadcast License executed under Section 5, constitutes the entire agreement between you and yforest regarding the Software, and supersedes any prior or contemporaneous agreements, representations, or understandings, whether written or oral.

Severability

If any provision of this Agreement is held unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Assignment

You may not assign or transfer this Agreement or any rights under it without yforest's prior written consent. yforest may assign this Agreement in connection with a merger, acquisition, or sale of assets without your consent.

No waiver

yforest's failure to enforce any provision of this Agreement is not a waiver of its right to do so later.
